Introduction

This privacy policy describes how the website and software owner, Conformify GmbH, (hereinafter «Conformify GmbH», CHE-370.402.517) handles personal data on its website and software. We inform you about our internal privacy policy guidelines and measures. Conformify takes great care to ensure the data protection of its website and software users and collects, processes and uses your personal data exclusively under the Swiss Federal Act on Data Protection («FADP») as well as – if and insofar as applicable – the General Data Protection Regulation («GDPR») and under the conditions laid out in the following text.

What is data protection and in what context does it apply here?

Data protection concerns the protection of processing personal data; the policy laid out here only concerns personal data which is collected on the domain of this website and software (conformify.com and portal.conformify.com). Personal data means any information that identifies or could be used to identify a natural person, that is information like name, address, telephone number, but, with regard to this scope of application also e.g. IP address and cookies. Processing of such data means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

On this website and software you have the possibility to transmit personal data to us (e.g. via the contact form or through the online shop). Web analytics – Google Analytics

This website uses Google Analytics for web analytics. Google Analytics assesses based on your cookies, how you use the website. This usage data (e.g. time, visited pages, new/already known user) are stored on a Google Server in the United States. However, if you do not accept cookies, this information will not be collected from you.

Social plugins

Social plugins are links between our website and social networks. These links are only activated when you click on the button of one of the social networks and thus connect your website visit with the social network. The exception to this rule is, when you are already logged in in a social network when visiting our website. If you are logged in to a social network which is linked with our page when visiting our website, the social network may automatically and directly connect your visit to our website with your user account. We do not have any influence over the purpose and amount of data social networks collect using social plugins. Conformify also has no influence over the further processing and usage of this data by the respective social network. Conformify Shop Powered by Conformify

While you visit our site, we’ll track:

  • Products you’ve viewed: we’ll use this to, for example, show you products you’ve recently viewed
  • Location, IP address and browser type: we’ll use this for purposes like estimating taxes and shipping
  • Shipping address: we’ll ask you to enter this so we can, for instance, estimate shipping before you place an order, and send you the order!

We’ll also use cookies to keep track of basket contents while you’re browsing our site.

When you purchase from us, we’ll ask you to provide information including your name, billing address, shipping address, email address, phone number, credit card/payment details and optional account information like username and password. We’ll use this information for purposes, such as, to:

  • Send you information about your account and order
  • Respond to your requests, including refunds and complaints
  • Process payments and prevent fraud
  • Set up your account for our store
  • Comply with any legal obligations we have, such as calculating taxes
  • Improve our store offerings

If you create an account, we will store your name, address, email and phone number, which will be used to populate the checkout for future orders.

We generally store information about you for as long as we need the information for the purposes for which we collect and use it, and we are not legally required to continue to keep it. For example, we will store order information for XXX years for tax and accounting purposes. This includes your name, email address and billing and shipping addresses.

We will also store comments or reviews, if you choose to leave them.

Data Used: For payments with PayPal or Stripe: purchase total, currency, billing information. For taxes: the value of goods in the cart, value of shipping, destination address. For checkout rates: destination address, purchased product IDs, dimensions, weight, and quantities.

Data Synced (?): For payments, we send the purchase total, currency and customer’s billing information to the respective payment processor. Please see the respective third party’s privacy policy (Stripe’s Privacy Policy and PayPal’s Privacy Policy) for more details.

Conformify Software
When you log in using a Microsoft or Google account, we may receive personal information such as your email address, name, city and title. This is to identify you as a logged in users.
Any information that you upload to the Conformify software is collected and stored securely with access granted to those in your organization with the assigned privileges and to administrators of Conformify to the extent that they need to carry out their administrative tasks.
Your IP address may be collected for the purposes of error logging, but is stored securely with access only to Conformify administrators.

 

Who on our team has access

Members of our team have access to the information you provide us. For example, both Administrators and Shop Managers can access:

  • Order information like what was purchased, when it was purchased and where it should be sent, and
  • Customer information like your name, email address, and billing and shipping information.

Our team members have access to this information to help fulfill orders, process refunds and support you.

Data transmission to third parties

Conformify in principle does not transfer your data to third parties, unless a) we are legally obliged to do so or b) you have given us your expressed consent to do so. Our website is run by a subprocessor, our hosting provider (Godaddy). Because of this, Conformify has to provide Godaddy with certain personal data. The service provider is, however, bound by contract to only process and use personal data for the same purposes as Conformify and in compliance with data protective regulations (including required safety measures).

Your rights

In accordance with and as far as provided by applicable law you have the to claim information about your personal data processed by Conformify, in particular concerning the purposes of processing, categories of personal data and receivers of your data and the planned storage duration and the following rights (within the restrictions of the applicable law):

  • Right to claim the correction of your personal data saved by us
  • Right to claim the deletion of your personal data saved by us unless our processing is necessary to exercise our right of freedom of expression and information, to fulfill legal obligations, for reasons of public interest or to exercise, assert or defend legal rights
  • Right to claim restriction of processing of your personal data
  • Right to object to data processing by Conformify (right of refusal)
  • Right to receive information about the existence of an automatic decision making
  • Right to revoke of your consent given to us at any time. The lawfulness of data processing until the revocation is not affected
  • Right to enforce your rights in court or complain with the competent data protection authority (in Switzerland: Federal Data Protection and Information commissioner: www.edoeb.admin.ch)

We reserve the right to enforce statutory restriction (e.g. legal obligation and / or overriding interest to process or save data) as far as provided by applicable law. To exercise your rights, please use the contact in section 9.
